We process all corporate and personal data in strict adherence to applicable Indian data protection frameworks, reflecting our corporate domicile and operational standards as of our 2026 incorporation. 6. Data Retention

We retain your account and CRM sync data for the duration of your active subscription to the OrbitAI . Upon account termination, data is systematically purged from our active databases within a standard 30-day window, retaining only the minimal documentation required to fulfill standard legal, tax, or regulatory compliance obligations.

7. Your Operational Rights

Workspace administrators and registered users possess the right to access, rectify, export, or permanently delete the personal and professional data hosted within their PitchNow environments. To execute a full data export or request a complete cryptographic wipe of your ecosystem data, please contact our support team.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the OrbitAI , website, API, CLI, and any related applications (collectively, the "Service"), operated by PITCHNOW APP PRIVATE LIMITED ("PitchNow," "we," "us," or "our"), an Indian corporate entity incorporated on 9th June, 2026 and headquartered at Shonit Kishore Village, Naddi Near Aliza Hotel, Dal Lake, Kangra, Dharamsala, Himachal Pradesh, India, 176216. By creating an account, accessing our website, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

PitchNow is a B2B AI Prospecting and smart content creation platform. The Service includes, among other capabilities, ICP-based lead sourcing, CRM enrichment, dynamic lead scoring (LeadFlow), AI-powered content generation and publishing (NarrativeAI, ContentFlow), and a configurable Agent Platform that allows customers to build, control, and deploy specialized AI agents for sourcing, enrichment, scoring, and outreach. We may add, modify, or discontinue features of the Service at our discretion, and will make reasonable efforts to notify customers of material changes.

3. Accounts & Eligibility

You must be at least 18 years old and capable of forming a binding contract to create a PitchNow account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to notify us promptly of any unauthorized use of your account. PitchNow is intended for business use by organizations and their authorized personnel, not for personal or household purposes.

4. Acceptable Use

You agree not to use the Service to: violate any applicable law or regulation, including data protection and anti-spam legislation such as the CAN-SPAM Act or equivalent regimes in your jurisdiction; harvest or process personal data without a lawful basis; send unsolicited communications that misrepresent their origin or purpose; reverse-engineer, decompile, or attempt to extract the underlying models or source code of the Service; resell or sublicense access to the Service without our written consent; or use PitchNow's outreach, scoring, or content-generation capabilities to harass, deceive, or defraud any individual or organization. We reserve the right to suspend or terminate accounts that violate this section.

5. Subscriptions, Billing & Cancellation

Paid plans are billed in advance on a recurring basis as described on our Pricing page or in your order form. Unless otherwise stated, fees are non-refundable except where required by law. You may cancel your subscription at any time; cancellation takes effect at the end of your current billing cycle, and you will retain access to the Service until that date. We reserve the right to change our pricing with reasonable advance notice, effective at your next renewal.

6. Intellectual Property

PitchNow and its licensors retain all right, title, and interest in and to the Service, including the ProspectIQ, NarrativeAI, LeadFlow, ContentFlow, and Agent Platform technologies, our trademarks, and all underlying software and models. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your organization's internal business purposes. You retain ownership of the data you upload to PitchNow and the content generated for your workspace, subject to the license you grant us in Section 7 to process it in order to provide the Service.

7. Customer Data & CRM Integrations

When you connect a CRM or other third-party data source to PitchNow, you grant us a limited license to access, process, and enrich that data solely to provide the Service to you, in accordance with our Privacy Policy. You represent that you have the necessary rights and consents to share such data with PitchNow and to permit our AI agents to process it for sourcing, scoring, and outreach purposes. Data processed through your workspace is kept siloed from other customers and is not sold to third parties.

8. AI-Generated Content Disclaimer

PitchNow's AI agents and modules — including NarrativeAI and the Agent Platform's Outreach Agents — generate drafts of emails, content, and other materials based on the data and prompts you provide. AI-generated output may occasionally be inaccurate, incomplete, or require adjustment. You are responsible for reviewing and approving any AI-generated content before it is sent to a third party or published externally, and for ensuring that your use of the Service complies with applicable communications and marketing laws in your jurisdiction.

9. Service Availability

We aim to keep the Service available and performant, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control. We will make commercially reasonable efforts to notify customers in advance of planned maintenance that may affect availability.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PitchNow and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use of the Service poses a risk to PitchNow, other customers, or third parties. Upon termination, your right to use the Service ceases immediately, and data will be handled in accordance with the retention schedule described in our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Himachal Pradesh, India.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will post the revised Terms on this page and update the effective date above. Material changes will be communicated to registered users via email or an in-app notice.
